Terms of Service

Please read these terms carefully — they govern your use of Hearth.

These Terms of Service and End-User License Agreement (the “Terms”) are an agreement between you and [Legal entity — fill in] (“Hearth,” “we,” “us”) governing your use of the Hearth mobile app and the hearth.photos website (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent where you live) to use Hearth, and you must be able to form a binding contract. Hearth is invitation-based and intended for adults to build and manage a private family album. If you are managing a family circle, you are responsible for ensuring that everyone you invite meets these requirements.

2. Your account

You are responsible for the accuracy of the information you provide and for all activity that happens under your account. Sign-in uses one-time codes sent to your email or phone; keep access to those secure and do not share your sign-in codes with anyone. Notify us at support@hearth.photos if you believe your account has been accessed without your permission.

3. License to use the app

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the Hearth app on devices you own or control, for your own non-commercial use in sharing photos within your family circle. You may not copy, modify, reverse-engineer, resell, or attempt to extract the source code of the Service except to the extent this restriction is prohibited by applicable law.

4. Your content and ownership

You own your content. The photos, videos, names, tags, and other material you add (“Your Content”) remain yours. We do not claim ownership of it.

License you grant us. To operate the Service, you grant Hearth a limited, worldwide, non-exclusive, royalty-free license to host, store, process, back up, and display Your Content solely for the purpose of providing the Service to you and the members of your family circle. This license exists only so we can show your memories to the people you share them with; it ends when you delete the content or your account, subject to the short backup windows described in our Privacy Policy. We do not use Your Content for advertising and we do not sell it.

Your responsibility. You represent that you have the rights necessary to upload Your Content and to tag the people in it, and that doing so does not violate anyone’s rights or any law.

5. Community standards — zero tolerance for objectionable content and abuse

Hearth has a zero-tolerance policy for objectionable content and abusive behavior. This is a place for families. Content or conduct that is objectionable has no place here, and accounts that violate this policy will be removed.

To report objectionable content or abusive behavior, use the in-app report and block tools or email support@hearth.photos. We take every report seriously.

6. Acceptable use

You agree to use the Service only for its intended purpose — privately sharing memories within a family circle — and to comply with all applicable laws. You may not use the Service to send spam, to collect other people’s information without permission, to probe or breach security, or to interfere with the Service’s operation.

7. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users. Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, and governing law — will continue to apply.

8. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or perfectly secure. You are responsible for keeping your own copies of important photos and videos.

9. Limitation of liability

To the maximum extent permitted by law, Hearth and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. To the extent liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Apple App Store terms

If you download the app from the Apple App Store, you acknowledge that these Terms are between you and Hearth, not Apple, and that Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. The license granted in Section 3 is limited to use on Apple-branded devices as permitted by the App Store’s Usage Rules.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app or by email. Your continued use of the Service after an update means you accept the revised Terms.
